As Bin Ulaşım ve Akıllı Şehir Teknolojileri A.Ş. (“BinBin”), we attach importance to the protection and confidentiality of the personal data of our users (“User(s)”) who benefit from our services. We would like to state that your personal data is processed and stored in accordance with the Personal Data Protection Law No. 6698 (“KVKK”). This Personal Data Protection and Privacy Policy (“Policy”) aims to provide information regarding the personal data collected, stored, processed, shared and transferred by BinBin. BinBin Users are within the scope of this Policy.

Personal Data Collected by BinBin

If you benefit from the services provided by BinBin, the following information is collected:

Your account information, your name, surname, date of birth, nationality, Turkish ID number, copy of the front and back side of your driver’s license (if using a moped), passport number, photocopy of passport, and your gender information.
Your phone number, your e-mail address if provided (shared with our Company within the scope of the consent to be given in case of login via Google or Apple), and your address information if provided.
Your customer transaction information (data regarding the services you have received from the Company and your preferences related to certain services).
Your phone brand and model and your payment card information.
Your photograph.
Your IP address and your device ID.
Location data collected during the registration and use of the application.
Request and complaint management data (if you have contacted the call center or reached live support services).

This information is processed for the purpose of providing the services we offer to you and limited to this purpose.

Our Purposes for Using the Information

BinBin uses the information collected regarding Users primarily for the purposes stated below:

Registration of prospective users into the system,
Execution of the user agreement,
Enabling the benefit from the transportation service provided by our Company within the scope of the user agreement,
Issuance of user invoices,
Follow-up of Users’ finance and/or accounting affairs,
Recording and tracking of user information,
Notification and follow-up of changes in user information,
Registration of user accounts,
Informing users regarding application updates and amendments to agreements,
Collection of calls received from users,
Recording and tracking of user requests and complaints,
Recording, tracking and concluding user complaints,
Carrying out and following up user communication,
Tracking of user sales reports,
Providing users with necessary information based on the contractual relationship,
Assisting users in emergencies,
Customization and improvement of the service,
Planning and/or execution of market research activities for the sale and marketing of the service,
Planning and execution of support service activities,
Planning and/or execution of activities for conducting efficiency/productivity and/or appropriateness analyses of business activities,
Planning and execution of business activities,
Planning and execution of corporate communication activities,
Planning and execution of logistics activities,
Planning and execution of production and/or operational processes,
Planning of the Company’s commercial and/or business strategies,
Planning of performance evaluation processes of employees and suppliers,
Use of the customer relationship management system for conducting marketing analysis studies,
Fulfillment of administrative obligations under the Turkish Penal Code, Code of Obligations, Consumer Law and other relevant legislation,
Detection of fraudulent or unlawful activities,
Follow-up and conclusion of lawsuits, enforcement proceedings and other legal/administrative processes,
Follow-up of consumer lawsuits,
Planning and/or execution of promotional activities and satisfaction activities,
Obtaining permission from the user for communication,
Enabling users to benefit from discounts and campaigns,
In case of obtaining approval from users, presenting promotions, campaigns and opportunities and making offers,
Carrying out the necessary work by the relevant business units and conducting the related business processes in order to enable the relevant persons to benefit from the services provided by our Company,
Monitoring of financial transactions,
Conducting after-sales support services,
Conducting, auditing and reviewing business activities,
Receiving, evaluating and concluding potential legal claims and complaints,
Evaluating the performance of call center employees,
Conducting activities in compliance with legislation.

In the presence of your explicit consent, your personal data may also be processed for the following purposes:

(i) Conducting data, customer and marketing analysis studies, creating campaigns by analyzing such data, contacting customers so that they can be informed about these campaigns and ensuring product usage,
(ii) Collecting information through surveys/calls/forms for the purposes of ensuring customer satisfaction and improving business processes,
(iii) Conducting communication activities,
(iv) Transferring personal data to our domestic service providers for the processing of personal data for the purposes listed in the above items.

Rights of the Users
As a User, we inform you that pursuant to Article 11 of the KVKK, you have the following rights:

To learn whether your personal data is processed,
To request information if your personal data has been processed,
To learn the purpose of processing your personal data and whether they are used in accordance with their purpose,
To know the third parties to whom your personal data is transferred domestically or abroad,
To request the correction of your personal data if it is processed incompletely or inaccurately and to request that the transaction carried out within this scope be notified to third parties to whom your personal data has been transferred,
To request the deletion or destruction of your personal data in the event that the reasons requiring its processing cease to exist, although it has been processed in accordance with the Law and other relevant legal provisions, and to request that the transaction carried out within this scope be notified to third parties to whom your personal data has been transferred,
To object to the emergence of a result against you by means of the analysis of the processed data exclusively through automated systems,
To request compensation for the damage in case you suffer damage due to the unlawful processing of your personal data.

Storage and Protection of Your Information

Personal data is stored by BinBin for the periods stipulated in the relevant legislation and in line with its legal obligations. If no period is stipulated in the legislation (especially in the KVKK) regarding how long personal data should be stored, personal data is processed for the period required in connection with the activity carried out by BinBin while processing that data, in line with BinBin’s practices and commercial customs, and thereafter deleted, destroyed or anonymized.

Personal data whose processing purpose has ended and personal data requested to be deleted/anonymized by the data subjects may be stored only for the purpose of constituting evidence in possible legal disputes or for the assertion of the relevant right related to the personal data or for the establishment of a defense, provided that the retention periods determined by the relevant legislation and BinBin have also expired. While determining the retention periods of personal data, BinBin takes as basis the statutes of limitation prescribed in the relevant legislation. Personal data stored for this purpose is accessed only by limited persons when required to be used in the relevant legal dispute and is not accessed for any other purpose. At the end of this period, personal data is deleted, destroyed or anonymized.

Transfer of Your Information to Third Parties

Your personal data processed within the scope of this disclosure text may, when necessary and limited to the information required by the transaction within the scope of the above-mentioned data processing purposes, be shared and transferred in accordance with the personal data processing conditions and purposes specified in Article 8 of the Law regarding the transfer of personal data; (i) to group companies for the purpose of providing services to users pursuant to the user agreement, (ii) to our suppliers and business partners for the purpose of providing services, and (iii) to other authorized public institutions and organizations if necessary.

Accuracy and Currency of Your Information

As a rule, the data within BinBin is processed as declared by the relevant persons. BinBin is not obliged to investigate the accuracy of the data declared by Users or persons who contact BinBin, nor is this carried out due to legal and operational principles. The declared data is deemed to be accurate. The principle of accuracy and up-to-dateness of personal data is also adopted by BinBin. Our Company updates the personal data it has processed based on official documents received or upon the request of the relevant person. Necessary measures are taken for this purpose.

Redirects to Third Parties

Our Service may contain links to third-party sites. If you click on third-party links, you will be directed to an external site. External sites are not operated by us. We recommend that you carefully read the terms of service and policies of these sites. BinBin is not responsible for the content, terms of service, and privacy policy of third-party sites.

Changes Made in the Mobile Application, Website and This Policy

BinBin reserves the right to make changes and updates to this Policy. It is the responsibility of the User to follow the current version of the Policy.

Your Rights Regarding Your Processed Data

In order to exercise your rights listed under Article 11 of the KVKK regarding your obtained and processed data, you may submit your request by filling out the Data Subject Application Form and delivering it in person with identity verification or by written application to Yamanevler Mahallesi, Sanayi Caddesi, No:56/1, Ümraniye/İstanbul; if available, via your registered electronic mail (KEP) address to our Company’s KEP address at binulasim@hs01.kep.tr; by using the electronic mail address registered in our Company’s system to kvkk@binbinscooters.com (in this case, mobile signature/secure e-signature is not required); by using an electronic mail address not registered in our Company’s system, including a mobile signature/secure e-signature, to kvkk@binbinscooters.com; or by other methods specified in the Law and relevant legislation.

If you submit your request to our Company, our Company will conclude the request free of charge as soon as possible and at the latest within 30 (thirty) days, depending on the nature of the request. However, if the transaction requires an additional cost, the fee in the tariff determined by the Personal Data Protection Board shall be charged by our Company.
