PERSONAL DATA PROTECTION AND PRIVACY POLICY

As Bin Ulaşım ve Akıllı Şehir Teknolojileri A.Ş. (“BinBin”), we consider the importance of personal data protection and privacy of the information of our users who benefit from our services (“User(s)”). Your data is processed and maintained following the Law on Protection of Personal Data No. 6698 (“LPPD”). This Personal Data Protection and Privacy Policy (“Policy”) is meant to provide information on the personal data collected, retained, processed, shared and transferred by BinBin. BinBin Users are covered by this Policy.
Personal Data Collected by BinBin In case you benefit from the services provided by BinBin, the following information is collected:
Your account information, first name, last name, date of birth, phone number, payment card information and e-mail address if provided by you.Location data during registration and use of the application. (This is necessary for the correct operation of our service and for the e-scooter to be displayed on the map.)Data on the location, routes and condition of the e-scooter. (BinBin uses the mentioned data to monitor the scooter, identify illegal actions related to BinBin’s property, and improve the services we provide.)Request and complaint management data (only if you have filled out our Contact Form).
This information is processed for the purpose of performing our services that we provide you and are limited to this purpose.
Our Purposes for Using the Information
BinBin uses the information which is collected from Users mainly for the following purposes:
Carrying out the necessary works by our business departments to benefit you from the services offered by BinBin,Performing the membership transactions of the Users,Resolution of User problems and complaints,Fulfillment and sustainability of our activities,To customize our services according to Users preferences, usage habits, and interests,To carry out the financial and accounting processes related to payments.Processing of Users information following the relevant legislation.
Following its purposes, it will be processed within the conditions and purposes of personal data processing specified in Articles 5 and 6 of the LPPD.


Rights of Users
We declare that you have the following rights following Article 11 of the LPPD as a User:
To learn whether your personal data is being processed or not, Request information if your personal data has been processed, to learn the purpose of processing your data and whether they are used in accordance with their purpose, To know the third parties to whom your data is transferred, in country or abroad, To request of your personal data in case of incomplete or incorrect processing and to request notification of the transaction made within this scope to the third parties to whom your data has been transferred,To object if a result arises to your detriment by analyzing the processed data exclusively through automated systems,To claim compensation for the damage in case you suffer damage due to unlawful processing of your personal data.
Storage and Protection of Your Information
Personal data is stored by BinBin for the periods stipulated in the relevant legislation and in line with its legal obligations. If a period is not regulated in the legislation (a specially in LPPD) regarding how long personal data should be stored, personal data is processed for a period that requires it to be processed in line with BinBin's practices and commercial practices in connection with the activity carried out by BinBin while processing that data, and then deleted, destroyed, or anonymized.
If the personal data whose purpose of processing has expired and the personal data requested to be deleted/anonymized by the personal data owners have expired, the relevant legislation and the storage periods determined by BinBin; can only be kept constituting evidence in possible legal disputes or to assert the relevant right related to personal data or to establish a defense. BinBin determines the retention periods of personal data based on the statute of limitations stipulated in the relevant legislation. The personal data stored for this purpose is only accessed by limited persons when it is required to be used in the relevant legal dispute and is not accessed for any other purpose other than this purpose. At the end of this period, personal data is deleted, destroyed, or anonymized.
Transfer of Your Personal Data to Third Parties
The information you provide to BinBin, may only be transferred to third parties in order to fulfil the above-mentioned purposes of the personal data of the data owerns governed by the Policy in accordance with Articles 8 and 9 of the (for example; it may be necessary to share your information with the company providing services in this regard in order to obtain technical support services). In this context, your information may be shared with our business partners and suppliers from whom support is received within the scope of product/service supply. However, when we are requested to share your information in order to fulfill our legal obligations, your information may also be shared with authorized persons, institutions and organizations.
Accuracy and Timeliness of Your Information
As a rule, the data held within BinBin are processed in the manner declared by the data subjects upon their declaration. BinBin is not obliged to investigate the accuracy of the data declared by Users or people who contact BinBin, nor is this done legally and due to our business principles. The declared data is considered to be correct. The principle of accuracy and timeliness of personal data has also been adopted by BinBin. It updates the personal data processed by our Company from the official documents received by it or upon the request of the relevant person. It takes the necessary measures for this.
Referrals to Third Parties
Our service may contain links to third-party sites. If you click on third-party links, you will be redirected to an external site. External sites are not operated by us. We encourage you to read the terms of service and privacy policies of these websites carefully. BinBin is not responsible for the content of third-party sites, their terms of service, and their privacy policy.
Changes to the Mobile Application, Website, and This Policy
BinBin reserves the right to make changes and updates to this Policy. It is the User's responsibility to follow the current version of the Policy.
Your Rights Regarding Your Personal Data Processed
In order to exercise your rights listed in Article 11 of the LPPD regarding your personal data obtained and processed, you can send your request in person to Saray Mahallesi Sanayi Caddesi No:56/1 Ümraniye, Istanbul address by filling out the Relevant Person Application Form or through a notary public; binulasim@hs01.kep.tr with electronic signature or mobile signature; kvkk@binbinscooters.com via e-mail, your request will be finalized free of charge as soon as possible and within 30 (thirty) days at the latest, depending on its nature. However, if the transaction requires an additional cost, the fee in the tariff determined by the Personal Data Protection Board will be charged by our Company. If your request is rejected, the reason(s) for rejection will be notified to you within 30 (thirty) days at the latest.
